1Consent
Only email people who asked to get your newsletter from you: they signed up on your form, or on another page where they clearly agreed to it. Keep a record of when and how each person signed up.
When you import contacts, you confirm that each of them agreed to get your emails. MailCheap leaves out invalid, role, throwaway, duplicate and suppressed addresses, and keeps the consent you confirmed with the import.
2Lists you can't use
- Bought, rented, borrowed, shared or traded lists.
- Addresses scraped, harvested or guessed from websites, social networks or directories.
- Lists from giveaways, co-registration or partners, where people didn't choose your newsletter.
- Cold email to people who never signed up.
3Unsubscribes
- Every email sent with MailCheap has an unsubscribe link and one-click unsubscribe headers. Don't remove, hide or break them.
- Never add back someone who unsubscribed, bounced or marked your email as spam.
- If someone asks you to stop another way, like by replying, remove them yourself right away.
4Honest emails
- Send from a name and address that are yours, with subject lines that match what's inside.
- Put a valid postal address in every email. MailCheap asks for one before you can send and adds it to the footer.
- Don't hide who you are, and don't forge headers.
5Content you can't send
- Anything illegal, or that promotes illegal activity.
- Phishing, impersonation, or attempts to get passwords or payment details under false pretenses.
- Malware, or links to it.
- Deceptive content: false claims, fake invoices or notifications, misleading subject lines.
- Sexually explicit or adult content.
- Gambling without a license where you and your readers are.
- Prescription drugs, unapproved medicines, controlled substances, or health products with false claims.
- Get-rich-quick offers, pyramid schemes and multi-level marketing.
- Harassment, threats or hate, and content that infringes someone else's rights.
6Bounces, complaints, pauses and blocks
Mailbox providers and our email providers judge every sender by bounces and spam complaints, so MailCheap watches them for you:
- A send pauses above 2% bounces (at least 5) or 0.08% spam complaints (at least 2), and we email you. You can resume it once you've checked your list.
- Above 5% bounces (at least 10) or 0.3% complaints (at least 3), on a send or over your last 7 days, your account is blocked.
- Your first send to contacts you've never emailed goes out in steps: a slice first, then the rest 3 hours later only if the slice stays under those rates.
- An email that reaches a spam trap blocks your account at once.
- Addresses that bounce or complain are suppressed for your account, so they don't get your emails again.
- If our email provider stops your sending, your account is blocked too.
- A blocked account sends nothing, welcome emails included, until we review it with you and unblock it.
7Using MailCheap itself
- Don't get around plan limits, rate limits or pauses, for example with several accounts.
- Don't probe, scan, overload or attack MailCheap, or use it to attack anyone.
- Keep full access API keys on servers and in your AI tools. Code that runs in browsers gets a signups-only key, which can only add contacts.
8Enforcement
If you break these rules, we can pause your sending, take issues off your archive, suspend your account or close it. Usually we email you first and give you a chance to fix the problem. For spam, phishing, malware or illegal content, we act right away. Accounts closed for breaking these rules aren't refunded.
We may report illegal activity to the authorities, and share information with our email providers or mailbox providers when they look into abuse.
