1Who we are
MailCheap is run by JustShipIt Pte. Ltd., 10 Petain Road, #04-01 International Plaza, Singapore 068914. You can reach us at hello@mailcheap.ai.
2What MailCheap does
MailCheap keeps your list of subscribers, lets you write newsletters, sends them and publishes them in a web archive. Everything you can do in the dashboard, you can also do through the REST API and the MCP server with an API key.
Each account has one user and up to 3 newsletters, which share its plan.
3Your account
You must be at least 18 and able to agree to these terms. Sign up with an email address you control: it's how you sign in and how we reach you.
Keep your sign-in and your API keys safe. You're responsible for everything done with your account and keys, including by AI agents you connect. Revoke a key as soon as you think it leaked.
4Plans and payment
MailCheap is paid and has no free trial. Plans are billed in advance, monthly or yearly, in US dollars, through Stripe, and renew until you cancel.
Each plan includes a number of emails a month and of subscribers, listed on the pricing page. Over a limit, signups and welcome and confirmation emails keep working, and campaign sends wait until you upgrade or, for emails, until your next month starts.
We can change our prices. We'll email you before a new price applies to you, and it applies from your next renewal, so you can cancel before then.
If a payment fails, Stripe tries again. If it keeps failing, your plan ends as if you had canceled it.
5Canceling and refunds
You can cancel anytime from the billing page. Your plan keeps working until the end of the month or year you paid for, then sending, signups and your archive stop. We don't refund partial months or years.
If we close your account without a breach of these terms on your part, we refund the unused part of your plan.
6Your content and your subscribers
Your newsletters, your list and what you upload stay yours. You allow us to store, copy, process, send and display them as needed to run MailCheap for you: to send your emails, publish your archive, show your stats and keep backups.
You must have the right to send what you send and to email the people on your list. You are the controller of your subscribers' personal data, and we process it for you, on your instructions, as the privacy policy describes.
Issues you publish in your web archive are public: anyone can read them.
7Acceptable use
You must follow the acceptable use policy, which is part of these terms. In short: only email people who asked for it, never use bought or scraped lists, honor unsubscribes, put your postal address in every email, and don't send illegal, deceptive or harmful content.
8Automatic pauses and suspension
During your first 30 days of sending, campaigns go out over hours instead of all at once: the first over 24 hours, the next two over 16 and 12, then each over 8. We can end this early for your account, or start it again if your bounces or complaints go up.
To protect delivery for every customer, a send pauses on its own when its bounces or complaints pass our first limits, and you can resume it. Your account is blocked on its own when a send, a first send to new contacts or your last 7 days pass our higher limits, when an email reaches a spam trap, or when our email provider stops your sending. A blocked account sends nothing, welcome emails included, until we review it and unblock it.
We can pause sending or suspend your account if you break these terms or the acceptable use policy, if your sending puts MailCheap, other customers or our providers at risk, or if the law requires it. When we can, we tell you first and give you a chance to fix the problem. For spam, phishing, malware or illegal content, we act right away and can close the account without a refund.
9Your data after you cancel
When your plan ends, we keep your account, newsletter, contacts and campaigns, so everything is back if you subscribe again. Export your contacts from the dashboard before you cancel, or ask us for them.
To have your data deleted, email hello@mailcheap.ai from your account's address. We delete it within 30 days, except records the law requires us to keep, like invoices.
10Our service
We work to keep MailCheap running and your data safe, but we can't promise it will always be available or free of errors, or that every email reaches the inbox: mailbox providers decide where email lands.
MailCheap runs on Amazon Web Services, PostShiba, MongoDB Atlas, Vercel, Stripe, Upstash and Resend, and their outages can affect it.
We can change or remove features. If a change takes away something you rely on, we'll tell you ahead of time.
11Liability
MailCheap is provided as is. As far as the law allows, we aren't liable for indirect or consequential losses, like lost profits, revenue, data or goodwill, and our total liability for any claim is limited to what you paid us in the 12 months before it. Nothing in these terms limits liability that the law doesn't allow us to limit.
If someone brings a claim against us because of your content, your list or how you used MailCheap, you cover our reasonable costs and losses from it.
12Changes to these terms
We may update these terms. We'll email you about changes that matter before they take effect. If you keep using MailCheap after that, the new terms apply; if you don't agree with them, cancel before then.
13Governing law
These terms are governed by the laws of Singapore, and the courts of Singapore decide any dispute about them. Before that, write to us at hello@mailcheap.ai: most problems are solved by email.
